1. Acceptance of Terms

By accessing or using Pingpoint ("the Service," "our app," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

2. Age Requirements and Verification

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age. If you are under 18, you are prohibited from using the Service.

During registration, you will be asked to provide your date of birth. You are solely responsible for providing accurate information. Any consequences resulting from providing false age information, including but not limited to legal liability, are entirely your responsibility. We have no obligation to verify the accuracy of age information provided by users.

3. Use at Your Own Risk

You acknowledge and agree that:

• Meeting strangers online carries inherent risks
• We do not conduct background checks on users
• Users may misrepresent themselves or their intentions
• You are solely responsible for your personal safety and security
• You should exercise caution when meeting anyone from the Service in person

4. Prohibited Conduct

You agree not to use the Service to:

• Harass, abuse, threaten, or intimidate other users
• Share, distribute, or solicit inappropriate content involving minors
• Engage in any form of sexual exploitation or abuse
• Impersonate any person or entity
• Share personal information of other users without consent
• Engage in spam, phishing, or other fraudulent activities
• Promote violence, terrorism, or illegal activities
• Distribute malware, viruses, or other harmful code
• Violate any applicable laws or regulations
• Circumvent our security measures or attempt to hack the Service
• Create multiple accounts to evade bans or restrictions

5. Account Termination and Refunds

5.1 Termination Rights

We reserve the right to suspend or terminate your account, including premium/paid accounts, for violations of these Terms of Service. Violations include but are not limited to:

• Spam, including unsolicited bulk messages or commercial solicitation
• Harassment, threats, or abusive behavior toward other users
• Posting content that violates applicable laws
• Impersonation or fraudulent use of the service
• Manipulation or abuse of platform features
• Attempting to circumvent platform restrictions or security measures

5.2 Warning System

For most violations, we may issue warnings before account termination. However, we reserve the right to immediately suspend or terminate accounts without prior warning in cases involving:

• Illegal activity
• Severe harassment or threats
• Fraudulent payment activity
• Other serious violations that require immediate action

5.3 Refunds for Terminated Premium Accounts

If your premium subscription is terminated by us due to Terms of Service violations:

• Refunds will be processed within 14 business days to your original payment method
• The refund does not waive our right to pursue additional legal remedies if applicable

5.4 Voluntary Account Deletion

If you choose to delete your account while a premium subscription is active:

• No refund will be provided for the remaining subscription period
• Your subscription will be canceled immediately
• Your account and associated content will be permanently deleted

Data retention after account deletion:

• Personal data (profile information, messages, content) will be deleted within 30 days
• Payment and transaction records will be retained for 7 years as required by accounting law and for tax compliance
• Anonymized usage data may be retained for analytics and service improvement
• Data necessary for fraud prevention, dispute resolution, or legal compliance may be retained as required by law or our payment processors

5.5. Chargebacks and Payment Disputes

If you dispute a charge with your bank/credit card company:

• Your account will remain active on the free tier
• Premium features will be disabled pending dispute resolution
• If the chargeback is resolved in your favor, premium access may be restored or refunded
• Users with multiple unresolved chargebacks may be restricted from future premium purchases as a fraud prevention measure
• We encourage you to contact us directly before initiating a chargeback, as we can often resolve billing issues more quickly

5.6. Subscription Refunds

Refund requests will be evaluated based on:

• Technical issues preventing service use
• Billing errors
• Subscription purchased within the last 14 days

Refund abuse prevention:

• Users who repeatedly subscribe and request refunds (more than twice in a 12-month period) may be restricted from premium purchases
• One-time refunds for legitimate technical or billing issues will not affect your ability to subscribe in the future

6. Limitation of Liability

Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

7. Service Features and Pricing

7.1 Free and Premium Features

Pingpoint offers both free and premium subscription tiers. We reserve the right to modify which features are available in each tier, including moving features from free to premium access.

Changes to feature availability:

• We will provide at least 30 days advance notice before moving any feature from free to premium access
• Existing users will receive notification via email and in-app announcement
• Features currently available may be modified, discontinued, or moved to premium tiers at our discretion

7.2 Core Free Features

As long as Pingpoint remains operational, the following will remain available to all users at no cost:

• Access to your friends list and connections
• Access to text messages you have sent and received for at least 10 years from the date the message was sent
• Basic account functionality and profile management

7.3 Media Storage

Media files (photos, videos, voice messages) sent through the service:

• Will be stored for a minimum of 3 months from upload date
• May be deleted after this period, particularly for inactive or non premium users

7.4 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any feature or functionality with reasonable notice
• Adjust pricing for premium subscriptions with at least 30 days notice to existing subscribers
• Introduce new premium tiers or features at any time

In the event of service shutdown, we will provide at least 90 days notice and offer data export functionality.

8. Indemnification

You agree to indemnify, defend, and hold harmless [Your App Name], its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your interactions with other users
• Any content you submit to the Service

9. Data Processing and AI

Our Service may use artificial intelligence and automated systems to:

• Match users based on preferences and behavior
• Detect and prevent inappropriate content
• Improve user experience and safety features
• Analyze usage patterns and optimize the Service

10. User Content and Intellectual Property

You retain ownership of content you submit to the Service, but you grant us a worldwide, non-exclusive, royalty-free license to use, modify, and display your content in connection with the Service.

You represent that you have all necessary rights to grant this license and that your content does not violate any third-party rights.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization] in [Jurisdiction]. You waive any right to participate in class action lawsuits.

14. Continuity of Service

While we strive for reliable service, we do not guarantee uninterrupted access. Our liability for service interruptions is limited to refunding the pro-rata subscription fee for the affected period. We are not liable for any indirect damages, lost content, or business losses resulting from service unavailability.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on our website or through the Service. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
